These Terms and Conditions (“Terms”) govern your access to and use of Ubered Social (“Service”).
Ubered Social is provided by Level Up North Ltd, trading as Ubered Social (“we”, “us”, “our”).
By creating an account, subscribing, or using Ubered Social, you agree to be legally bound by these Terms.
Who We Are
Ubered Social is a service operated by Level Up North Ltd, a company registered in the United Kingdom.
Ubered Social provides social media scheduling, publishing, and AI-assisted content tools using platform technology made available by Level Up North Ltd.
Definitions
In these Terms:
Account means the user account created to access the Service
Content means all posts, captions, images, videos, links, hashtags, text, prompts, and other materials uploaded, generated, scheduled, or published through the Service
AI-Assisted Content means content generated or suggested using automated or artificial intelligence features within the Service
Social Platforms means third-party social media platforms connected to the Service
Subscription means the paid or trial plan granting access to the Service
You / User means the individual or organisation using Ubered Social
Eligibility & Business Use
Ubered Social is intended solely for business, organisational, or professional use.
By using the Service, you confirm that:
You are at least 18 years old
You have authority to bind the organisation you represent
You lawfully control or are authorised to manage all connected Social Platform accounts
Scope of the Service
Ubered Social enables you to:
Connect supported Social Platform accounts
Schedule and publish Content
Manage posting calendars and queues
Use AI-assisted tools to generate or refine Content
View publishing status and limited engagement indicators
The Service does not:
Guarantee reach, impressions, engagement, or outcomes
Control Social Platform algorithms, moderation, or decisions
Provide legal, regulatory, advertising, or professional advice
AI-Assisted Content – Responsibility & Risk
Ubered Social may include AI-assisted features to help generate or suggest Content.
You acknowledge and agree that:
AI-Assisted Content is generated automatically and may be inaccurate, incomplete, biased, outdated, or inappropriate
AI-Assisted Content is provided for convenience only and does not constitute advice
You are solely responsible for reviewing, editing, approving, and validating all Content before publication
You must ensure all Content complies with:
Applicable laws and regulations
Advertising and consumer protection rules
Social Platform terms and policies
Intellectual property and copyright laws
We make no warranties as to the accuracy, legality, originality, or suitability of AI-Assisted Content. Use of such features is entirely at your own risk.
Fair Use, Posting Limits & System Integrity
Ubered Social is designed to provide reliable and equitable access for all users. Use of the Service is therefore subject to fair use principles.
Fair use means usage that is reasonable, proportionate, and consistent with:
Your Subscription tier
Normal business or organisational usage patterns
The need to preserve system performance and availability for all users
We may apply reasonable limits to protect the integrity of the Service, including (but not limited to):
Limits on the number or frequency of posts scheduled or published
Limits on concurrent scheduling actions
Limits on connected accounts or queue depth
Throttling of automation or high-frequency actions
Limits on AI request volume or processing consumption
What constitutes fair or excessive use is determined at our reasonable discretion, taking into account system load, technical constraints, and the impact on other users.
Excessive or Disruptive Usage
Usage may be considered excessive or disruptive where it:
Causes or risks system instability, latency, or outages
Creates unfair bottlenecks for other users
Circumvents safeguards or intended limits
Involves abnormal automation or high-frequency behaviour
Consumes a disproportionate share of AI or system resources
Where such usage occurs, we may take protective measures without prior notice.
AI Usage, Surcharges & Top-Ups
Your Subscription may include an allowance for AI-assisted features.
Where AI usage:
Exceeds fair or included allowances, and
Causes or risks detriment to system performance or capacity,
we may, at our discretion:
Apply usage-based AI surcharges, or
Require the purchase of AI top-ups to continue access to AI features
Any applicable surcharges or top-ups will be calculated by reference to excess usage and charged in accordance with your billing arrangement. Failure to pay may result in restriction or suspension of AI features.
Unless expressly stated in writing, no usage is unlimited, including AI usage.
Third-Party Social Platforms
Ubered Social integrates with independent Social Platforms
You acknowledge that:
Social Platforms operate under their own terms, rules, and algorithms
Platform outages, restrictions, API changes, suspensions, or content removals are outside our control
Content may be delayed, rejected, restricted, or removed by Social Platforms
We accept no liability for actions or decisions taken by Social Platforms.
Your Responsibilities
You agree that you:
Own or have permission to use all Content
Will not upload unlawful, misleading, defamatory, or infringing material
Will not rely solely on AI-Assisted Content without human review
Will comply with all applicable laws and platform rules
Will keep login credentials secure
Are responsible for all activity carried out through your Account
Content Ownership & Licence
You retain full ownership of your Content.
By using Ubered Social, you grant us a limited, non-exclusive licence to host, process, transmit, and publish Content solely for the purpose of providing the Service.
Data Protection
Each party agrees to comply with UK GDPR and the Data Protection Act 2018.
You act as data controller for personal data included in Content.
We act as data processor, where applicable, solely to provide the Service.

Subscriptions, Billing & Payments
Subscriptions are billed in advance
Fees are non-refundable except where required by law
Prices may change with reasonable notice
Non-payment may result in suspension or termination
Service Availability & Force Majeure
We aim to provide a reliable service but do not guarantee uninterrupted availability.
We shall not be liable for any failure or delay in performance resulting from events beyond our reasonable control, including (without limitation):
Platform, software, or infrastructure outages
Failures of hosting providers or third-party services
Internet or telecommunications failures
Cyber-attacks, data centre failures, or power outages
Acts of God, natural disasters, pandemics, or government action
During such events, our obligations are suspended and we are not liable for losses, damages, or business interruption suffered by you.
Disclaimers & Limitation of Liability
The Service is provided “as is” and “as available”.
To the maximum extent permitted by law:
We are not liable for indirect or consequential loss
We are not liable for loss of profits, revenue, data, goodwill, or reputation
Our total liability is limited to the fees paid by you in the preceding 12 months
Nothing excludes liability that cannot be excluded under UK law.
Indemnity
You agree to indemnify us against claims arising from:
Your Content or use of AI-Assisted Content
Your use of Social Platforms
Breach of these Terms
Violation of law or third-party rights
Changes to the Service or Terms
We may update the Service, pricing, or these Terms from time to time.
Continued use constitutes acceptance of any updated Terms.
Governing Law & Jurisdiction
These Terms are governed by the laws of England and Wales.
The courts of England and Wales have exclusive jurisdiction.
